Intruder injures elderly woman, jailed

A four-year prison sentence has been given to a man who forcibly entered the house of an octogenarian, resulting in her sustaining injuries. The criminal, identified as James Maloney, a 44-year-old resident of Mellows Park, Finglas, Dublin 11, was found guilty of infliction of harm and endeavouring theft at a Santry premises on 1st February, 2023 by the Dublin Circuit Criminal Court.

Officer Andrew McDonald shared with prosecutor Eoin Lawlor that the incident occurred around 3 pm, when Maloney knocked on the woman’s door, equipped with documents and began interrogating her. The victim endeavoured to shut the doormultiple times in vain, resulting in Maloney pushing her, leading to her falling and striking her head. He subsequently demanded the car keys, causing the resident to disclose their location before escaping to call for help.

A case of head injury and injury to arm and hand was diagnosed when she was admitted to Mater hospital. The culprit was identified by procured CCTV footage, after which he confessed to the crime at Ballymun Garda station on his own accord, claiming personal drug debt as the motive.

The woman’s prepared statement, submitted to the court, elaborated on her injuries, the significant wait for medical attention, and the precautions she has since taken, which included a front door replacement that cost €3,000.

Maloney’s defence attorney, David Perry, highlighted the defendant’s remorse, conveyed in a written apology and his life status at that time – a homeless drug addict.

Judge Elma Sheahan decreed a four-year imprisonment for Maloney concerning his attempted burglary allegation, in addition to two years and four months for the charge of assault that led to injury. The two penalties are to be served at the same time.

“According to the documents submitted to the court, it appears that the accused is striving for rehabilitation, thus, I will adjourn the last six months of his imprisonment term for half a year,” stated Judge Sheahan.
