Two doctors located in Western Ireland have found a resolution to their conflict in High Court, following the end of their professional partnership. Dr Eva Flynn and Dr Sean Mullin, who are both general practitioners, had collaborated at the Moycullen Health Centre in County Galway. A temporary order was attained by Dr Flynn in April, restricting Dr Mullin from prohibiting her access to the clinic they had co-operated since 2022, and from interfering with her provision of patient care at the centre.
Court proceedings initially adjourned, providing a space for out-of-court negotiations to occur in the hopes of finding a resolution. Upon returning to High Court this week, Dr Mullin’s representative, Arthur Cush BL, informed Mr Justice Mark Sanfey that the dispute had been resolved through mediation. He further mentioned that with mutual consent, the proceedings will adjourn again to a later date this year to enforce the conditions of the confidential settlement agreement.
It is proposed that in the next hearing, the case can be entirely dismissed – this would mean no recurrence before the judge. No further information about the agreement was disclosed.
Dr Flynn, represented by Con Crowley BL and instructed by lawyer Owen Swaine, had alleged Dr Mullin was unlawfully trying to exclude her from the partnership and assume complete control of the business. The doctors had jointly acquired and remodelled the property where the clinic operates, which was equitably shared as “tenants in common.” The partnership dissolved due to disagreements concerning finances and workload, and Dr Flynn contended that the dissolution was not conducted lawfully by Dr Mullin.
Concerned about potentially losing access to the clinic and her patients, Dr Flynn sought High Court orders. Dr Mullin, in response, firmly denied all allegations raised against him.
