Dublin-based firefighter Terence Crosbie accused of sexually assaulting a female at a Boston hotel post-St Patrick’s Day festivities, has been kept in custody with a consecutive $100,000 cash bail ruling following his Tuesday appearance in Boston’s Municipal Court.
Due to the prosecution not being prepared for the scheduled probable cause hearing, attorney Nicholas Babaian asked Judge James Stanton to defer the hearing, which the judge accepted. Mr Crosbie, who has been held at Nashua state prison for around four weeks, remained silent during the swift court appearance, though he clarified that his forename had only a single ‘r’ when the judge raised the topic.
Mr Crosbie, aged 37, has been indicted for the purported assault of a 28-year-old female at Boston’s Omni Parker House on March 19th, a Monday. He and his colleagues from the Dublin Fire Brigade had arrived in Boston the previous Thursday, March 14th, for the city’s St Patrick’s Day revelries.
Assistant District Attorney Erin Murphy affirmed that the victim’s statement had been taken at Massachusetts General Hospital by Boston police officers the day after the alleged assault, during which she stated that the hotel was the site of the assault.
A statement by the Suffolk County District Attorney’s office disclosed that CCTV footage had been collected from the Black Rose bar in Boston where Crosbie and the victim had spent Thursday night. Crosbie was questioned by the police on Saturday and booked a flight to Ireland at 10.10pm. However, he took an earlier flight from Logan airport but was removed from the plane by state police.
Mr Crosbie, represented by defence attorney Patrick Garrity and his colleague Dan Reilly, did not contest the prosecution’s request to reschedule the probable cause hearing, during which it’ll be decided if there is enough proof to proceed with a trial. Dan Reilly highlighted that their client had been in detention since his charge and claimed that the prosecution has not yet shared requested discovery with the defence team.
Maintaining the same bail amount, Judge Stanton set down the motion for protection request and assigned May 1st as the date for probable cause hearing, when another mid-May date is expected to be established. Crosbie’s defence team plans to petition for a bail review from the superior court, hoping for an alteration in terms amidst ongoing legal proceedings.
