“Cerberus Planned Ard Rí Hotel Purchase”

The Treacys Hotels Group, a family enterprise, pursued legal actions to enforce a contract for the purchase of Ard Rí Hotel, a prestigious property in view of Waterford city, from US company Cerberus at the price of €1.6 million. Evidence was presented in court on Friday suggesting that Cerberus intended to approve the €1.6 million offer by the Treacys. An email dated 22nd November and sent by Darren Das, an advisor to Cerberus, to Chris Allen of Ernst & Young, was tendered to the court by Martin Heydon SC, the legal representative of Treacys Hotels Group. The email demonstrated Cerberus’s intention to go through with the deal, provided the Treacys could show evidence of being able to cover the outstanding balance of the agreed price. The group made a non-refundable deposit of €160,000 on the property on November 21st, 2016. The property later ended up being sold to another bidder, Seamus Walsh. Despite initially proposing €1.25 million, Mr Walsh upped his offering to €1.5 million. A member of the Treacy family, Maria Keena, is asking the High Court to mandate the completion of the sale of the Ard Rí Hotel to their group, by Cerberus subsidiary, Promontoria Aran Ltd and receiver Luke Charleton of EY, the previous Ernst & Young.
